Appeals Court Reopens Puerto Rico Urology Antitrust Suit

 |  December 11, 2022

A group of Puerto Rican doctors succeeded in resurrecting claims that a health insurer and a medical practice used exclusive dealing arrangements to corner the Medicaid urology market in the western part of the island.

The US Court of Appeals for the First Circuit held Thursday that the physicians leading the lawsuit had standing to bring it. That ruling reversed a decision by Judge Silvia Carreño-Coll, who found in 2020 that patients harmed by the lack of urology options were better positioned to file antitrust claims.
