The CNMC ruled against the maximum seniority requirement for obtaining transport permits for new entrants. They also considered the rejection of seniority requirements in the case of authorizations for complementary private transport to be illegal.
While FENADISMER does not share this position on behalf of the CNMC, the entity explained that “European regulation on public transport by road is not applicable to private transport… the European Court itself had the opportunity in its judgment of February 2018 to analyze the seniority requirement… without any objection to it. ”
The association considers it “essential” to maintain these requirements due to what they consider to be a “worrying” age among the land transport fleets in Spain, reaching 13 years on average for rigid vehicles, 7 and a half years for tractor trucks, and 9 years in light vehicles. The maximum age requirement, says the association, would affect “in a very positive way […] in the reduction and improvement of road accident rates borne by our sector …”
