Spain: CNMC looks favorably on regulation of e-services, but demands caution

The National Commission for Markets and Competition (CNMC) sees as “positive” the creation of a new legal framework to regulate certain aspects of electronic services, although it advocates exercising caution in the exchange of sensitive information among potential competitors.

So-called ‘Trusted’ electronic services include those related to the creation, verification and validation of electronic signatures, electronic stamps or certificates for the authentication of websites, among others.

“The proper functioning of these services is essential for security and trust in electronic transactions and communications,” stresses the CNMC, which generally considers the new regulation “positive”.

The regulator has said that it would be advisable to have data that could reveal the irregularities and market distortions detected to date, in order to better assess the measures to be applied, especially those that go beyond what is required by European regulation.
