Spain: CNMC recommends that Treasury increase competitors in contract bids

Spain’s National Commission of Markets and Competition (CNMC) has issued a series of recommendations to different government agencies aimed at improving centralized purchasing processes. Among these recommendations, the agency requested that the number of competitors participating in these public tenders be increased.

    The CNMC also recommends enhancing transparency and accessibility, giving more depth to market analysis related to tendering, and even experimentally implementing a new dynamic sourcing system.

    This formula seeks to open the market to a greater number of suppliers, reducing the risk of manipulating bids with the intent to damage competition or earn undue advantage. In this regard, the agency advises not to limit the number of bidders or, in any case, not to fix it at too small a number “which restricts competition in a particularly severe manner.” The CNMC report is non-binding but is issued upon request from the Ministry of Finance in order to analyze such processes.
