The Sixth Chamber of the Santiago Court of Appeals this week will hear the case presented against the resolution which imposed the payment of compensation for damages in a widespread price-fixing scheme perpetrated by Chilean paper company CMPC and Swedish-based SCA Chile.
The resolution may be struck down by the court, as the Tribunal for the Defense of Free Competition (TDLC), one half of the country’s competition regulation framework, has yet to issue a final sentence. SCA, which brought forth the case for appeal, has insisted that the demands of consumer advocates CONADECUS and SERNAC should be rejected outright, as no final sentence has been given by the TDLC.
SERNAC has also sued the Swedish-based SCA, with their case being taken up to the country’s Supreme Court. “In the case of SCA, we are going all the way to the highest court, because our lawsuit was initially declared inadmissible, which was unfortunately not reverted upon first appeal. We are working to ensure that these reparations should come from the collective process recognized by the most recent reform to the law” said SERNAC director Ernesto Muñoz.
