Spanish company Lidercon has been granted a judicial mandate allowing it to once again be the only authorised provider of technical inspection services for vehicles within Lima’s metropolitan area. Lima’s 13th Administrative court issued a cautionary statement, ordering two of Lidercon’s competitors to close up shop.
The court further determined that it should be the Ministry for Transport and Communications (MTC) that should be in charge of implementing this resolution. The court’s decision also orders the MTC to revoke all prior resolutions which would allow other companies to operate vehicle inspection services within the Peruvian capital. Judge Martha Hinostroza Bruno, in defending the ruling, argued that the MTC had violated the existing concession contract between Lidercon and the Municipality of Lima.
In response, the Association for Vehicular Technical Inspection Centers, which represents both of the affected competitors, has confirmed it has filed an appeal against the court’s measure. The companies have also presented a formal complaint against judge Hinostroza, as they consider the order to be “illegal”, as it goes against the principles of free competition enshrined in the country’s constitution.
