EU competition law in innovation and digital markets: fairness and the consumer welfare perspective when we see data as output – like financial data or supermarket scanner data being sold as such – we treat it like any other output.
When we see data as an input being purchased or as an asset being generated within the firm, we may raise concerns that data accumulation may prevent competitors from accessing sufficient data, to the detriment of consumers.
