Mexico Watchdog Fines Companies For Colluding In Tenders For Services For Lab Tests

Mexico’s competition commission determined that 11 companies coordinated their bids or abstained from bidding in several tenders convened by both public health institutions to the detriment of the treasury and affiliates.

The conducts generated a damage to the treasury amounting at least one thousand 200 million Mexican Pesos due to the payment of overprices by IMSS and ISSSTE to the sanctioned companies.

COFECE fined the involved economic agents a total of 626 million 456 thousand Mexican pesos.

The aforementioned constitutes an absolute monopolistic practice, sanctioned by the Federal Economic Competition Law, by being arrangements and information exchanges between competing economic agents, with the purpose and/or effect of coordinating bids in public tenders.

According to a statement released by the firm on Monday, both lawyers have joined as partners, bringing a wealth of expertise in various facets of competition law.

Martino Sforza’s practice focuses on a range of areas, including consumer protection, data privacy, and regulated markets, in addition to his extensive work in antitrust matters. His broad experience makes him a valuable addition to the firm’s Milan office.

Veronica Pinotti, also joining from White & Case, specializes in advising clients on complex legal matters involving joint ventures, mergers and acquisitions, cartels, and abuse of dominance. She is also highly experienced in navigating state aid issues and regulatory concerns.
