Peru’s Commission for the Defense of Free Competition that they had sanctioned Cencosud Retail Perú, Hipermercados Tottus, Makro Supermayorista and Supermercados Peruanos in the first administrative instance for price fixing in the sale of whole turkey San Fernando brand at national level between 2009 and 2016.
The fine, which totals S/17,240,000, also includes the San Fernando company for being an intermediary Sign during the 2015 and 2016 Christmas promotions. The penalty for the latter is 410.32 UIT.
According to Indecopi, “The breach consisted of setting a floor price for whole San Fernando turkey, which companies priced against to keep them artificially increased in the months of December” during the 7 years that the agreement lasted, according to the documents obtained by the institution.
In this regard, Hypermarkets Tottus issued a statement denying Indecopi’s allegations. In addition, he emphasized that his “activity was always carried out in strict compliance with the legal framework and the rules of free competition”.
In this sense, Cencosud also denied its involvement in “alleged price fixing” and emphasized that its internal policies reject any kind of violation of free competition.
