Spanish regulator CNMC (National Commission for Markets and Competition) has initiated a disciplinary action against ATRESMEDIA CORPORACIÓN DE MEDIOS DE COMUNICACIÓN, S.A. and its subsidiary ATRES ADVERTISING, S.L.U, as well against MEDIASET ESPAÑA COMUNICACIÓN, S.A. and its subsidiary PUBLIESPAÑA, S.A.U. (jointly, MEDIASET), over possible uncompetitive practices in the broadcast advertising sector.
The companies have been accused of violating EU competition laws through the conditions imposed through advertisers and media agencies, which include obligations that could be contrary to the proper functioning of the market, by unfairly segmenting and closing off a part of it.
The broadcasters are accused of demanding media agencies to meet relative investment quotas, as well as the joint contracting of advertising in different channels and bundling of services. The CNMC will have 18 months to analyze and resolve the file.
