Spanish competition regulator, the National Commission for Markets and Competition, has initiated sanction proceedings against telecommunications operator Telefónica over an alleged policy of discrimination against its competition – primarily Orange and Vodafone – which took place during the month-long strike among installation technicians which struck Movistar between March and May 2015.
“Going by the data analyzed by teh CNMC, we find enough evidence to find Telefónica guilty of failing its obligation to non-discrimination, a productof their significantly powerful position within the broadband wholesale market” said the CNMC in a statement.
The files indicate that Telefónica is oblicgated to provide for third parties the same resources as it gives itself, under the same conditions and timeframes, and as stated in the CNMC approved wholesale offers. The non-discrimination obligation on Telefónica includes both service quality and delivery times, as well as service conditions. Should the allegations stand, Telefónica could be liable for a severe infraction of the General Telecommunications Law.
