A Critical Appraisal of the Spanish National Competition Commission’s Guide on Public Procurement and Competition

On February 7, 2011, the Spanish National Competition Authority (Comisión Nacional de la Competencia, CNC) published its Guide on Public Procurement and Competition with the goal of offering practical recommendations that contribute to the promotion of effective competition in public procurement procedures for the benefit of contracting authorities and citizens. This is an interesting advocacy effort that follows previous CNC recommendations in the field of public economic activities, particularly through its Recommendations to Public Authorities for a More Efficient and Competition Oriented Market Regulation (2008). This article critically appraises the Guide on Public Procurement and Competition and advocates for some additional proposals to further promote effective competition in public procurement procedures.
