Public Procurement for Self-Production of Goods and Services: The European Example of in House Providing

The article deals with the subject of in house providing, an original model of adjudication founded in Europe as an exception to the general rule of public tender for the award of public contracts. After a preliminary introduction of the reasons that led to the adoption, at a European level, of the rules on public procurement, the author analyses the various requirements for in house providing, both in light of existing case law from the European Court of Justice, and under the new EU Directives on Public Procurement. This paper concludes by proposing a reading of in house providing consistent with the recently emerged European legal framework, with particular regard to its role and limitations.
