Spain: CNMC reopens case struck down by court; 51 companies fined

Spain’s National Commission of Markets and Competition (CNMC) announced on May 3 that it will reopen a disciplinary proceeding against 51 waste management and urban sanitation companies for possible anticompetitive practices.

In January 2015, the CNMC sanctioned various entities in the waste management and urban sanitation sector over violations to Article 1 of the country’s Antitrust Law, with fines totalling €98.2 million euros to against companies.

At the time, the National Assembly upheld the appeals filed by these companies and associations against the CNMC’s resolution, striking it down after finding problems in the way the CNMC conducted its analysis, although it did not question the facts supporting the anti-competitive conducts detected, including price-fixing, distribution of clients, and fixing commercial conditions, among others.
